Abstract

Background. Despite all the importance of such institution as regional constitutional justice, so far the order of organization, functioning and abolition of the constitutional (charter) courts regions of the Russian Federation has received no unified regulation at the federal level. The purpose of the work is to formulate problems of standard legal regulation of the organization and activities of the constitutional (charter) courts of territorial subjects of the Russian Federation in the aspect of distribution of areas of jurisdiction and powers between the Russian Federation and regions of the Russian Federation and also to offer solutions to these problems.
Materials and methods. The research tasks were implemented through analyzing legal acts regulating activities of the constitutional (charter) courts in regions of the Russian Federation as an integral part of the system of constitutio nal justice of the Russian Federation. Federal and regional regulatory legal acts contain a significant amount of contradictions and gaps concerning regulation of activities of the specified bodies of constitutional control in regions of the Russian Federation.
Results. The author has researched regulatory legal acts at the federal and regional levels, the practice of the Constitutional Court of Russia, as well as the statistical data on activities of the constitutional (charter) courts of the Russian Federation. The issues of standard and legal regulation of activities of the constitutional (charter) courts regions of the Russian Federation and the implementation of the specified provisions are quite problematic. In this regard, in order to solve the designated problems the author has offered own options of further development of the system of constitutional (charter) courts in regions of the Russian Federation.
Conclusions. The implementation of the competences by territorial subjects of he Russian Federation regarding elaboration of the laws regulating the specified questions is not absolutely rational. This sphere shall be regulated unified federal regulatory legal acts that will fully promote implementation of the principle of equality of territorial subjects of the Russian Federation and strengthening of the federal initiatives.
